1. Our contract
In these terms, “we”, “us” and “our” mean About Cambodia Travel & Tours. These terms apply to every booking, whether it is made through our agents or consultants by phone, in person or by email, or online through our website. By booking with us you agree to these terms, and a contract exists between you and About Cambodia Travel & Tours.
We rely on the authority of the person making the booking to act for everyone travelling on it, and that person binds all of those travellers to these terms.
If these terms conflict with any other written agreement between you and About Cambodia Travel & Tours, that other agreement takes precedence to the extent of the conflict.
2. Booking and deposit
Unless we or your agent tell you otherwise before you book, a deposit is required to confirm your booking. The deposit is 30% of the total booking value (or the equivalent if you pay in another currency), and it is what you pay at checkout.
If you cancel, what we retain from the deposit is set out in clause 5, which governs. If we cancel your tour, clause 7 applies.
3. Acceptance of booking and final payment
If we accept your booking, we issue a confirmation invoice, and the contract between us exists from the date of that invoice. If you book within 30 days of departure, the contract exists when we accept your payment.
Full payment is due at least 30 days before your departure date. If it has not been received by then, we may cancel your booking. Special offers may require full payment earlier, as stated in the offer. Your confirmation invoice sets out the final payment details.
4. Price and surcharges
All prices are in United States dollars (USD) unless stated otherwise. Prices depend on availability and may be withdrawn or changed without notice. Your price is guaranteed only once you have paid in full and we have issued a confirmation invoice.
Prices can change because of things outside our control that raise the cost of the services we provide or arrange — including currency movements, fuel costs, taxes and hotel rates. If a surcharge raises the trip price by more than 15%, you may cancel within 20 days of receiving notice of it and receive a full refund. Airline taxes may change and are confirmed when your ticket is issued; some airports also charge local taxes.
5. Cancellations by you
If you cancel all or part of your booking, cancellation fees apply. Cancellations must be made in writing, and we do not process one until we have received your written notice. This clause governs what we keep, including out of your deposit: where the fee is less than the deposit you have paid, we refund you the difference. Subject to your rights under applicable consumer law, we retain:
Any fees your bank or card issuer charges on a refund are yours to pay, and we are not liable for them.
Optional activities listed in your quotation and paid for before travel can be cancelled up to 25 days before departure. Cancelling them within 25 days of departure incurs a 100% fee.
We strongly recommend travel insurance with cancellation cover, taken out when you book. Subject to your rights under applicable consumer law, if you leave a trip after it has started we are not obliged to refund unused services, and if you do not join a tour, join it late or leave it early, no refund is made.
6. Changes to your booking
If you want to change any part of your booking, including moving to a different trip, tell us in writing at least 30 days before departure. We will do our best, but a change depends on availability and may cost more for the new date. Any extra cost must be paid within 15 days of the invoice. Some arrangements cannot be changed at all and may incur a 100% cancellation charge.
You may ask to transfer your booking to someone else who meets all the conditions of the trip. The request must be in writing at least 15 days before departure and include proof that the new traveller accepts the transfer. You and the new traveller remain jointly liable for any supplier charges, including booked flights, train tickets, allocated accommodation and non-refundable supplier costs. Some suppliers refuse transfers and treat them as a cancellation and a new booking.
7. Cancellations by us
We may cancel a trip at any time before departure because of unavoidable or extraordinary circumstances, or if the minimum number of travellers for a tour or excursion is not reached.
Unavoidable or extraordinary circumstances means anything outside our reasonable control that could not have been prevented even with all reasonable measures. That includes, but is not limited to, war or the threat of war, riot, civil disturbance, industrial disputes, terrorism and its consequences, epidemics, pandemics and other public health crises (including quarantine and other restrictions), natural and other disasters, nuclear incidents, fire, actual or threatened adverse weather, closed or congested airports and ports, unavoidable technical problems with transport, unforeseen timetable changes, domestic and international travel restrictions, changes to immigration, labour or free-movement laws affecting Cambodia, and the rescheduling of aircraft, boats or other transport.
If such a cancellation happens before your trip starts, we will first offer comparable alternative arrangements where available, refunding the difference if the alternative costs less. We may also offer a travel credit for the full amount you paid. Alternatively, we may refund everything you paid for the trip — except flights and insurance, which follow their own terms — less any unrecoverable costs.
If it happens after your trip has started, we will first offer comparable alternative arrangements where available, refunding the difference if the alternative costs less. We may also offer a pro-rata travel credit for the remaining days. Alternatively, we may refund what you paid for the trip — except flights and insurance — less any unrecoverable costs.
Unrecoverable costs means all reasonable, direct costs we have incurred for your trip, including amounts paid to suppliers for parts of your arrangements.
We are not responsible for incidental expenses arising from your booking, such as visas, vaccinations, insurance excesses or non-refundable flights.
8. Changes by us
We make every effort to run every tour as sold, but it is sometimes necessary to use other accommodation or services for reasons outside our control. We may change any tour, accommodation or arrangement at any time if we consider it necessary.
If we make a material change before departure, we will tell you as soon as reasonably possible. If it is made more than 15 days before departure, you may:
You must tell us your choice within 15 days of our notice. If you do not, you are treated as having accepted the change.
We may change an itinerary after departure because of local circumstances or events outside our control. You are responsible for any extra costs those necessary changes cause, and no further compensation is paid. You and About Cambodia Travel & Tours release each other from any further obligations that would have applied had the tour not been cancelled.
A material change is one that seriously affects your trip: a change of departure date, departure point or airport, a departure time moved by more than 9 hours, or anything else that causes you substantial inconvenience. A change of accommodation type, size or style, or of transport type, size, method or style, is not a material change — transport may vary with the number of travellers. In some countries, laws on drivers’ hours may require public transport in certain cities.
9. Supplier change and cancellation fees
Cancelled bookings may also incur supplier fees of up to 100% of the total booking value, whether or not travel has started. Supplier fees may also apply when a booking is changed or tickets and documents are reissued. If we become liable for a supplier fee on a booking you change or cancel, you agree to reimburse us for it.
If you ask for a refund on a cancelled booking that we have already paid a supplier for, we cannot refund you until the supplier has refunded us, which can take 15 weeks or longer. Where we still hold the money, we can refund it only once the supplier authorises it under its own change or cancellation policy.
10. Special requests
Tell us when you book about any special request, such as ground-floor rooms, disability access or dietary requirements. We will try to meet it but cannot guarantee it, and we accept no responsibility for what we cannot provide. If we reasonably believe we cannot meet your needs, we may decline the booking, or require you to travel with a companion, at your cost, who can give you full assistance throughout the tour.
11. What the tour price excludes
Unless your itinerary specifically includes them, the tour price excludes airfares, airport transfers, departure taxes, early or late hotel check-in, tips, personal expenses and some meals. We are happy to quote for transfers, early check-in or anything else you need.
12. Vaccinations
You must know the health requirements and recommended precautions for your trip and carry any vaccination documents you need; without them you may be refused entry to a country. We recommend seeing your doctor, a travel medicine service or a vaccination clinic before your tour.
13. Travel insurance
Every traveller must have travel insurance, arranged when you book. It must cover personal accident, injury, death, emergency repatriation and medical expenses, with a recommended minimum of USD 100,000 for each. We also strongly recommend cover for cancellation, curtailment, personal liability and lost luggage. Insurance that comes with a credit card, and reciprocal medical agreements, are often not comprehensive. Carry your policy number and emergency contact number while you travel. Making sure your cover is sufficient, and meeting its conditions, is your responsibility.
If you make a claim against us, you agree to assign to us or our insurers any right to take action against a third-party supplier, tour operator or anyone else who may be wholly or partly responsible, or whom we reasonably consider should be a party, and to cooperate fully if we or our insurers enforce those rights.
If your claim against us is covered by your insurance, you agree to pursue it through your insurer as well as, or instead of, through us. We will reimburse reasonable expenses you incur in successfully pursuing such a claim, and any settlement by your insurer does not affect your rights against us.
14. Travel documents, passports and visas
Check your travel documents to make sure names, dates and times are correct. Read your invoice and everything we send as soon as it arrives, and tell us straight away if anything looks wrong. Subject to your rights under applicable consumer law, failing to give us details we ask for may mean extra charges or the non-refundable cancellation of your trip.
Travel documents include your itinerary, airline tickets, hotel and tour vouchers, and any other document, electronic or otherwise, confirming an arrangement with a supplier. They may be non-refundable, non-changeable or subject to change fees, and they cannot be transferred to another person.
Every traveller needs a valid passport. Many countries require at least 6 months’ validity from your return date, and some require a machine-readable passport. Having valid passports, visas and re-entry permits is your responsibility. Fines, penalties and costs caused by documents that do not meet the requirements are yours, except where caused by our fault, and we are not responsible if you are refused entry to a country.
15. Travel advice
We recommend checking your government’s travel advice website before you travel.
16. Flight schedule changes
We recommend contacting your airline 48 hours before your flight to confirm the departure time.
17. Conduct
You must follow our instructions at all times. Subject to local law, you agree to reimburse us for any loss or injury caused by not doing so. You must learn and respect the laws, customs and social expectations of the countries you visit, and must not disturb or offend other travellers.
You are responsible for any damage you cause to our property or anyone else’s. We are not responsible for loss or damage you suffer through failing to respect local law or custom. Subject to local law, you indemnify us against third-party claims for loss or damage caused by you or arising from your part in the tour.
You must wear a seatbelt at all times in any vehicle. Neither About Cambodia Travel & Tours nor its related companies, directors, shareholders, employees or agents are liable for injury, death or any claim arising from an accident if you were not wearing one.
18. Feedback
If you are unhappy with anything we have arranged, tell your guide or travel consultant at the time so they can try to put it right. Feedback after the tour must reach us in writing within 7 days of the tour ending; after that, our ability to investigate may be affected.
19. Photography
While on tour, other travellers, we or our representatives may take photographs or video that include you. You consent to this, and grant us and our affiliates a perpetual, royalty-free, worldwide, irrevocable and fully sublicensable right to use and reproduce your likeness for any purpose — including marketing and promotional material, by us or our sublicensees — in any medium and without payment to you.
20. Our role as agent for third-party suppliers
We may arrange some or all of your booking with third-party suppliers, such as airlines, coach, rail and boat operators, hotels, restaurants and excursion providers. We choose reputable suppliers with care, but we have no control over, and no liability for, the services they provide.
Their services are subject to their own terms, including conditions of carriage and limits of liability. Except where a problem is caused by our fault, your legal rights for those services are against the supplier, not us — even when our guide is with you at the time. If a supplier cannot provide a service you contracted for, for any reason other than our fault, your rights are against that supplier.
21. Money paid to us
All money you pay us becomes our property and is a debt payable to the supplier once the related services have been provided. It is not held on trust for you. We may hold it in any account we consider appropriate, including together with our own money or other customers’ money.
22. Flexibility during the trip
We make every effort to run each trip as described, but the itinerary sometimes has to change and delays can happen for reasons beyond our control. A flexible attitude matters on this kind of travel. Decisions about the itinerary are made by the guide we appoint, in the interests of the group as a whole. Some sights or activities may be unavailable on public holidays. No refund is made for services you do not use after the trip has started, for any reason.
23. Optional activities and excursions
We make no representation or warranty about any service, activity or event that is suggested or recommended but not expressly included in your itinerary. You bear all risks of travelling to, taking part in or visiting any place, activity or excursion not listed as an inclusion in your quotation.
During your trip you may be offered optional excursions and activities. We do not own, run or control the companies or people that provide them. If you take part, you must be fit enough to do so and follow all reasonable instructions. Their health and safety standards are those of the country where the activity takes place, which may differ from your home country’s.
If you book an optional activity, you do so on the operator’s terms, your contract is with the operator under local law, and we act only as the operator’s agent. Neither About Cambodia Travel & Tours nor its related companies, directors, shareholders, employees or agents accept any liability, in contract, tort or otherwise, for injury, damage, loss (including consequential loss), delay, extra expense or inconvenience caused directly or indirectly by the acts, omissions or default, negligent or otherwise, of any operator or its employees, agents or subcontractors.
24. Liability
Your booking is accepted on the understanding that you appreciate and accept the risks of travel. These include, but are not limited to, travel in undeveloped areas; travel by boat, train, bus, car, aircraft or other means; forces of nature; civil unrest; different standards of sanitation and safety; risks from food, water, plants, insects and animals; disease and its transmission; accident or illness where evacuation is difficult or medical facilities poor; and acts of government. The risks may be greater on tours with adventure activities such as kayaking, cycling, hiking or climbing. By booking, you confirm you have considered this and are aware of the personal risks of travel.
To the extent the law allows, and without limiting any other indemnity in these terms, neither About Cambodia Travel & Tours nor its related companies, directors, shareholders, employees or agents accept liability, in contract, tort or otherwise, for injury, damage, loss (including consequential loss), delay, extra expense or inconvenience caused directly or indirectly by:
Except for death or bodily injury, and subject to local law, any liability we or our affiliates have to you is limited to the price you paid us for your tour. Our liability is also limited to the extent allowed by relevant international conventions, including the Montreal Convention for air travel, the Athens Convention for sea travel and the Berne Convention for rail travel. Where our liability cannot be excluded but can lawfully be limited, it is limited to the remedies required by applicable law.
This clause is subject to your rights under applicable consumer law, including Cambodian consumer law where your booking is made in Cambodia. Nothing in these terms is intended to limit those rights.
25. Data protection
We are committed to protecting your personal information and handle it in line with our privacy policy.
By giving us personal information, you agree that our privacy policy applies to how we handle it, and you consent to us collecting, using and disclosing it. In some cases we may disclose it to recipients overseas — for example airlines, hotels or tour providers you are booked with, usually in the country where they provide the service or are based.
We may also disclose it to our related entities overseas and to service providers working for us, generally only to arrange your booking or to carry out administrative and technical work on our behalf.
Where we disclose your personal information to anyone, including an overseas recipient, you agree that we are not required to ensure their compliance with privacy law and are not accountable for how they handle it.
26. Severability
If any part of these terms is invalid in a jurisdiction, it is invalid there only to that extent, and neither the rest of these terms nor that part’s validity elsewhere is affected.
27. Acknowledgement
By booking, you acknowledge that you understand and agree to these terms.
